Cases and Statutes About Horses

Ever had a lawsuit involving a horse? For example, have you ever had a horse and car collision case? A case where a person riding a horse got hurt? How about a case arising out of a breach of contract concerning the sale of a horse?

Here is a site that collects the law of horses. Really.

If you have a PI case that involves a person injured while riding horse be sure to read the Tennessee Equine Activity Act.

Indeed, there is even a list of law review articles on point.

Three dogs ran my horses through my fence and onto a main road through town. One of the horses was hit and killed by a Chevy S-10 pick-up. The driver of the vehicle was not insured on the vehicle, it was his girl friends, and the insurance company would not touch the case. The owner of the truck is trying to sue me for $7000.00+ dollars for repairs of the truck. My fence is in good order and in compliance with Tennessee Code. The lady trying to sue me has never seen my barn or fence and has no knowledge of the circumstances involved in the horses being out. Without knowledge of the conditions can I be found liable for the truck?

Tom - I simply do not have enough information to give you legal advice over the Internet and have made it a policy not to do so even if I believed that I had all the facts.

You should talk with a lawyer and you should turn this over to your homeowner's insurance company. My guess (and it is just a guess, I have not seen your policy)is that you homeowner's coverage protects you for this claim. If you do have coverage the insurance company will provide you will a lawyer.

Good luck.
